Kow Abaka Essuman, a former board member of the Minerals Income Investment Fund (MIIF), has filed a formal application with the Right to Information Commission (RTIC) to compel the Fund to release information it has allegedly withheld in violation of transparency laws.
The application, submitted on 25 November 2025, accuses MIIF of an “express and deemed” refusal to respond lawfully to multiple Right to Information requests filed between September and October 2025.
According to the filing, MIIF failed to provide the requested information or cite any lawful exemptions for its refusal, despite repeated written requests and subsequent applications for an internal review—a key step required by the Right to Information Act, 2019 (Act 989).
Essuman, in his application, contends that MIIF’s conduct constitutes a breach of both his constitutional right to information under Article 21(1)(f) of the 1992 Constitution and the Fund’s own statutory transparency obligations under the Minerals Income Investment Fund Act, 2018 (Act 978).
The relief sought from the RTIC includes an order compelling MIIF to immediately disclose the information, which is believed to concern audited financial statements and statutory reports.
The application also requests the Commission to impose administrative penalties on MIIF under Section 71 of Act 989 for what is described as “wilful non-compliance.”
The case highlights ongoing tensions over accountability and public access to information within Ghana’s state-owned enterprises, testing the enforcement powers of the RTI Commission against a significant mineral revenue management institution.
MIIF is yet to issue a public statement regarding the allegations.
